Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and RaceHype ("RaceHype", "we", "us" or "our") and govern your use of our mobile application, website and related services (together, the "Service"). By creating an account or otherwise using the Service you confirm that you have read, understood and accepted these Terms.

1. The Service

RaceHype is a discovery platform for races, events and organizers. We aggregate information from organizers and third-party sources and link you onwards to organizer websites where you can register or buy tickets. RaceHype does not sell tickets, organize events or act as a party to any agreement between you and an organizer.

2. Eligibility and account

  • You must be at least 13 years old (and have parental consent if required by your country's digital consent age) to use the Service.
  • You are responsible for the information you provide and for keeping your login details secure.
  • You may not share your account, impersonate someone else or create an account on behalf of another person without authority.

3. Acceptable use

When using the Service you agree not to:

  • Use the Service in breach of applicable law or these Terms.
  • Upload or share content that is unlawful, infringing, defamatory, discriminatory, threatening, sexually explicit, or otherwise harmful.
  • Scrape, copy, reverse engineer, decompile or extract data from the Service except as permitted by mandatory law.
  • Interfere with, overload or attempt to gain unauthorised access to the Service or related systems.
  • Use the Service to send unsolicited marketing, spam, malware or to harvest personal data.

We may suspend or terminate accounts that breach these rules.

4. Third-party content and links

Race information, images and links are sourced from organizers and third parties. We do our best to keep this information accurate but cannot guarantee that it is complete, current or error-free. Always confirm dates, prices, rules and registration details on the organizer's official channels before relying on them. Any registrations, payments, refunds or disputes relating to an event take place directly between you and the organizer and are governed by the organizer's terms.

5. User content

You retain ownership of any content you submit to the Service (e.g. reviews, ratings, profile information). By submitting content you grant RaceHype a worldwide, royalty-free, sublicensable and transferable licence to host, store, reproduce, modify, create derivative works of, communicate and display that content for the purpose of operating, promoting and improving the Service. You confirm that you have all rights necessary to grant this licence.

6. Intellectual property

The Service, including software, design, logos, text, graphics and trademarks, is owned by RaceHype or its licensors and is protected by Swedish and international intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your private, non-commercial use. All rights not expressly granted are reserved.

7. Privacy

Our processing of personal data is described in our Privacy Policy. By using the Service you acknowledge that we may use your data — including behavioural and usage data — for analytics, product improvement, personalised recommendations and marketing as described in the Privacy Policy and permitted by applicable law.

8. Beta features and changes

We continuously develop the Service. We may add, modify, suspend or discontinue features at any time, with or without notice. Beta features are provided on an experimental basis and may contain bugs.

9. Disclaimer of warranties

To the maximum extent permitted by mandatory law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, nor that any event information is correct.

10. Limitation of liability

To the maximum extent permitted by mandatory law (and without limiting any rights you have as a consumer under Swedish law that cannot be waived), RaceHype, its directors, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of the Service, including but not limited to your participation in, cancellation of, or inability to attend any race or event listed in the Service.

Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (i) the amount you have paid us in the twelve months before the event giving rise to the claim, or (ii) SEK 1,000.

Nothing in these Terms excludes or limits liability for personal injury or death caused by our negligence, for intentional misconduct or gross negligence, or for any liability that cannot be excluded under mandatory Swedish law.

11. Indemnity

You agree to indemnify and hold RaceHype harmless from any claim, damage, liability, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service or your infringement of any third-party rights.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including sections 5, 6, 9, 10, 11, 13 and 14) shall survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in the app or by email at least 14 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by Swedish law, without regard to its conflict-of-law rules. Disputes shall be resolved by the Swedish general courts, with Stockholms tingsrätt as the court of first instance, unless mandatory consumer law gives you the right to bring proceedings in another forum.

If you are a consumer in the EU you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr or turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN).
